The case arises from an October 2024 claim by sci-fi author Matthew Kelsey Martineau, who alleged that Bungie appropriated key ideas from a story he published under the pseudonym Caspar Cole. Both Martineau's work and Destiny 2’s original Red War campaign share similar elements, such as the “Red Legion” faction, flamethrowers, and war hounds.

Bungie’s defense is complicated by the removal of the campaign from the game and its placement into the Destiny Content Vault, rendering it unplayable. The judge declined to review the suggested 10-hour lore videos, highlighting the difficulty of preserving evidence in evolving live-service games where content can become inaccessible over time.
