Nintendo Sues Over Premature Switch 2 Mockup Release

Nintendo has taken legal action against accessory manufacturer Genki, alleging trademark infringement after Genki showcased renders of a "Nintendo Switch 2" mockup at CES 2025, months before Nintendo officially unveiled its new console. Genki claimed that their mockup was based on a real Switch 2 system they had allegedly seen and used to develop their accessories.

According to court documents reviewed by IGN, Nintendo accuses Genki of launching a "strategic campaign" to exploit public interest in the upcoming console. The lawsuit includes charges of trademark infringement, unfair competition, and false advertising. Nintendo contends that Genki falsely boasted about having early access to the unreleased console, allowing guests to interact with the mockups, and misleading the public about the compatibility of their accessories with the Nintendo Switch 2.

The court papers state that in January 2025, Genki advertised unauthorized access to the Nintendo Switch 2, which had not yet been revealed by Nintendo. Despite later retracting their claim of possessing a genuine console, Genki continued to assert that their accessories would be compatible with the Nintendo Switch 2 upon its release.

Nintendo also alleges that Genki infringed on its trademarks through its advertising, which directly competes with Nintendo's and its licensees' marketing of authorized accessories. Additionally, Nintendo took issue with a tweet from Genki on January 20, featuring CEO Edward Tsai and the caption "Genki ninjas infiltrate Nintendo Kyoto HQ," along with a website pop-up stating, "Can you keep a secret? We can’t..."

In its lawsuit, Nintendo seeks to prevent Genki from using the "Nintendo Switch" name in its marketing, demands the destruction of any products or marketing materials referencing Nintendo's branding, and requests unspecified damages for infringement, unfair competition, and false advertising, to be trebled.

Over the weekend, Genki responded on social media, acknowledging the lawsuit and stating they are working with legal counsel. Genki emphasized their independence and commitment to creating innovative gaming accessories, expressing pride in their work and standing by the quality and originality of their products. While unable to provide detailed comments, Genki confirmed they are preparing for PAX East and fulfilling orders. They thanked supporters and reiterated their focus on building gear for gamers.

The Nintendo Switch 2 is scheduled to debut on June 5, with pre-orders starting on April 24 at a fixed price of $449.99. Due to high demand, Nintendo has warned U.S. customers that release date delivery is not guaranteed for those who pre-ordered through the My Nintendo Store.
